Waiver and Release of Liability for Kirlian Device Purchase or Rental

This waiver and release of liability ("Agreement") applies to the purchase or rental of any Kirlian photography device ("Device") from Images SI Inc. By purchasing or renting a Kirlian device, you ("User") acknowledge that these devices operate using high-voltage electricity and, as such, present inherent risks. You further agree to the following terms and conditions:

Assumption of Risk

You understand and acknowledge that high-voltage devices, including Kirlian photography equipment, are potentially hazardous and can cause serious injury, electrical shock, or death if not used properly. By purchasing or renting this Device, you voluntarily assume all risks associated with its use, including but not limited to personal injury, property damage, or other harm that may arise from direct or indirect contact with the Device, improper use, or equipment failure.

Disclaimer of Warranties

Images SI Inc. makes no warranties, expressed or implied, regarding the fitness of the Kirlian device for any particular purpose other than those specifically listed in the Device’s operational guidelines. The Device is provided on an "as-is" basis, and Images SI Inc. disclaims any warranty of merchantability or fitness for a particular purpose, including but not limited to any claims relating to the effectiveness, functionality, or performance of the Device.

Limitation of Liability

In no event shall Images SI Inc., its officers, employees, agents, or affiliates, be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of the purchase, rental, use, or misuse of the Kirlian device. This includes, but is not limited to, any injury, loss, or damage resulting from electrical shock, fire, equipment malfunction, or any failure to follow the safety guidelines provided by Images SI Inc.

You agree that Images SI Inc. is not responsible for any legal fees, expenses, losses, or delays arising from damages to or failure of the Device, including claims related to loss of profits, medical expenses, or other consequential damages.

Indemnification

You agree to indemnify, defend, and hold harmless Images SI Inc., its affiliates, officers, and employees from and against any and all claims, demands, actions, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the Kirlian device, including any failure to adhere to the safety precautions outlined in this Agreement.

Safety Precautions

By purchasing or renting the Device, you acknowledge and agree to adhere to the following safety guidelines:

1. General Safety:

   • The Kirlian device requires 117 VAC standard US electrical power and draws approximately 7 to 10 watts of power. For international customers, appropriate voltage converters must be used.
   • This equipment is not suitable for use by children or individuals unfamiliar with electrical safety precautions.
   • The Device must not be used in the presence of individuals with implanted inductive devices, such as pacemakers.

2. Eye Protection:

   • Use UV-protective eyewear, such as glass-lensed sunglasses, when viewing the corona discharge. The glass will absorb harmful short-wave UV rays.

3. Physical Exposure:

   • Limit skin exposure to the corona discharge to no more than 1 minute per day. Tingling sensations or slight shocks are inherent to the operation of the Device.

4. Operating Environment:

   • Operate in a well-ventilated area to prevent the accumulation of ozone, which may cause throat irritation at concentrations of 0.5 to 1.0 PPM.

5. Handling Precautions:

   • Ensure the work area is dry, and wear rubber-soled shoes to reduce the risk of shock.
   • Keep the Kirlian device at least 10 feet away from mobile phones, tablets, or other personal electronic devices, which may be permanently damaged by proximity to the high voltage.

6. Cooling Period:

   • Do not run the Device for more than 30 seconds continuously. Allow a cooling period of at least one minute between exposures.

User Responsibilities

• You agree not to operate the Device if you have a heart condition, are pregnant, or have any medical condition that may render you susceptible to electrical shocks.
• Ensure that your work area is free from potential grounding risks and that you work in a clean, organized environment.
• Never leave the Device unattended while it is plugged in or operational.
• Always verify that the Device is disconnected from power before handling it.

Certification and Acknowledgment

By completing this purchase or rental and submitting your information, you certify that you are at least 18 years of age and possess the necessary training, education, and experience to safely operate the Kirlian photography device. You acknowledge that you have read and understood this waiver, including the safety precautions and your assumption of risk. You further understand that failure to follow these guidelines may result in injury or damage, and you release Images SI Inc. from any liability associated with such incidents.
